A bold new approach to combatting the inherent corruption of representative democracy This provocative book reveals how the majority of modern liberal democracies have become increasingly oligarchic, suffering from a form of structural political decay first conceptualized by ancient philosophers. Building on the anti-oligarchic institutional innovations proposed by plebeian philosophers, she rethinks the republic as a mixed order in which popular power is institutionalized to check the power of oligarchy. Vergara demonstrates how a plebeian republic would establish a network of local assemblies with the power to push for reform from the grassroots, independent of political parties and representative government. Drawing on neglected insights from Niccolò Machiavelli, Nicolas de Condorcet, Rosa Luxemburg, and Hannah Arendt, Systemic Corruption proposes to reverse the decay of democracy with the establishment of anti-oligarchic institutions through which common people can collectively resist the domination of the few. En particular, se aborda la función sistematizadora de las ideas y el problema del uso hipotético o regulativo de las mismas, así como el vínculo entre ambas funciones. En este texto quiero hacer un análisis de las propuestas de paz del gobierno de Uribe Vélez y sus efectos en las instituciones y la cultura democrática colombiana. El análisis no pretende evaluar directamente si las propuestas de paz fueron efectivas para dar por terminado el conflicto, sino mostrar el vínculo que existe entre una democracia débil, como la colombiana, la gran influencia de la personalidad de Uribe Vélez en el imaginario político y sus proyectos de seguridad democrática y de (...) estado comunitario, en la medida en que estos proyectos hicieron parte de sus propuestas de paz. La tesis central que defiendo en este artículo es que precisamente la debilidad democrática colombiana permitió que una propuesta como la de Álvaro Uribe frente a la paz fuera apoyada por una inmensa mayoría, aunque esta propuesta en vez de profundizar la democracia hubiese debilitado más sus instituciones y la cultura ciudadana. RESUMEN El artículo reflexiona sobre las políticas de la memoria que deberían desarrollarse en sociedades donde han ocurrido masivas violaciones de derechos humanos, y cuyos procesos se guían por los principios normativos de la justicia transicional. Se analizan primero los conceptos de memoria e historia, y la forma como el Holocausto trans formó sus tareas en el siglo XX; luego se examinan dos modelos de responsabilidad propuestos por Iris Marion Young, y se propone cómo usarlos en la justicia transicional. ABSTRACT The article carries out a reflection on the politics of memory that should be developed in societies where massive human rights violations have occurred and whose pro cesses are being guided by the normative principles of transitional justice. It starts out by analyzing the concepts of memory and history and the manner in which the Holocaust transformed their tasks in the 20th century. Ten it goes on to examine two models of responsibility proposed by Iris Marion Young, and suggests how to use them in transitional justice. The development of neuropsychological assessment methods using virtual reality (VR) is a valid and promising option for the detection of cognitive impairment in the older people, focusing on activities composed of tasks of multiple demands. This study verified the association of age, schooling, and general cognitive status on the performance of neurologically healthy older adults in ECO-VR, a virtual reality task of multiple demands for neuropsychological assessment. A total of 111 older adults answered a sociodemographic questionnaire, the Mini Mental State (...) Examination, the Vocabulary subtest of the Wechsler Intelligence Scale for Adults (third edition), and the ECO-VR. Correlation analyses, multiple linear regression, and comparisons between groups (effects by age and schooling groups) were used to evaluate the results. The ECO-VR total score was significantly associated with age, years of education, MMSE, and Vocabulary subtest. The linear regression models identified that age was the main predictor for total score and rule breaking of ECO-VR. According to the univariate analysis, it was identified the main effect of age group and schooling group in the total ECO-VR score, but there was no interaction effect. The results are discussed in order to understand the role of sociodemographic characteristics in the performance of older adults in a virtual reality task of multiple demands. It was also verified the possibility use of virtual reality for neuropsychological assessment of older adults. (shrink)

: This response to Nikolaus Knoepffler's paper in the same issue of the Journal agrees that if the arguments supporting the first two of the eight human embryonic stem cell research policy options discussed are unsound, as Knoepffler argues, then it seems natural to move to the increasingly permissive options. If the arguments are sound, however, then the more permissive options should be rejected. It is argued that three of the rejected arguments, taken together, constitute very good reasons to hold (...) that a human embryo is endowed with dignity from fertilization onward. Thus, countries that want their public policies to match the moral imperative of respect for human beings should refrain from allowing destructive human embryo research and should devote considerable energy and public funds to research and clinical trials using non-embryonic ("adult") stem cells. In this provocative new work, Alfonso Gomez-Lobo proposes that the earliest Platonic writings, in particular Apology, Crito, and sections of Gorgias, contain an underlying moral philosophy that can be attributed to Socrates with some degree of assurance. His aim is to show that Socratic moral philosophy is a reasonably systematic construction generated by a small number of principles or axioms.

The article presents a plebeian strand of republican constitutional thought that recognises the influence of inequality on political power, embraces conflict as the effective cause of free government, and channels its anti-oligarchic energy through the constitutional structure. First it engages with two modern plebeian thinkers – Niccolò Machiavelli and Nicolas de Condorcet - focusing on the institutional role of the common people to resist oppression through ordinary and extraordinary political action. Then it discusses the work of two contemporary republican thinkers (...) – Philip Pettit and John McCormick – and contrasts their models of ‘contestatory’ and ‘tribunician’ democracy. Finally, I incorporate a political economy lens and propose as part of republican constitutionalism not only contestatory and tribunician institutions but also anti-oligarchic basic rules to keep inequality and corruption under control. By offering an analysis of different conceptions of corruption connected to the political regime and contingency in which they developed, the article retrieves a systemic meaning of political corruption. Through the works of Plato, Aristotle, Polybius and Machiavelli, it reconstructs a dimension of political corruption particular to popular governments and also engages with recent neo-republican and institutionalist attempts at redefining political corruption. The article concludes that we still lack a proper conception of systemic corruption comparable to the one of the (...) Ancients because we are yet unable to account for the role procedures and institutions play in fostering corruption through their normal functioning and what this means for liberal democratic regimes. El presente trabajo se propone exponer el carácter problemático de la base sistemática de la estética hegeliana desarrollada en la Enciclopedia a partir del análisis de algunas de sus temáticas centrales y de las modificaciones que sufren en las tres ediciones de esta obra. Primero se examina la definición enciclopédica del ideal y la noción de obra de arte contenida en ella. Luego se aborda la disputada cuestión de la autonomización del arte respecto de la religión. The aim of this paper is focused on presenting the method of historical analysis built by Michel Foucault in his book Histoire de la Folie à l’Âge Classique as a “History of the Other”. Such term appears for the first time at Les Mots et les Choses’s Preface, in which Foucault analyses his method in the quoted book on madness (but also in La Naissance de la Clinique). In this sense, firstly we have to verify the hypothesis of this relation (...) between Foucault’s archeological method as a Thought of the Otherness, precisely concerning to that “Other History” proposed by the philosopher. In this book, Camila Loew analyzes four women’s testimonial literary writings on the Holocaust to examine and question some of the tenets of the fields of Holocaust studies, gender studies, and testimony. Through a close reading of the works of Charlotte Delbo, Margarete Buber-Neumann, Ruth Klüger, and Marguerite Duras, Loew foregrounds these authors’ search for a written form to engage with their experiences of the extreme. Although each chapter contains its individual focus and features, the book possesses a unity (...) in intention, concerns, and consequences. In the theoretical introduction that unites the four chapters, Loew eschews essentialism and revises the emergence of the field of Women and Holocaust studies from the early 1980s on, and signals some of its shortcomings. In response, and in accordance with a recent turn in various disciplines of the Humanities, Loew highlights the ethical dimension of testimony and its responsible commitment to the other. In dealing with the texts as literary testimonies—a complex genre, between literature and history—, testimony is freed from the obligation to respond to the requirements of factual truth, and becomes a privileged form to voice the traumatic event, and to symbolically explore the role of excess. In this paper I argue that some examples of what we label ‘algorithmic bias’ would be better understood as cases of institutional bias. Even when individual algorithms appear unobjectionable, they may produce biased outcomes given the way that they are embedded in the background structure of our social world. Therefore, the problematic outcomes associated with the use of algorithmic systems cannot be understood or accounted for without a kind of structural account. Understanding algorithmic bias as institutional bias in particular (as (...) opposed to other structural accounts) has at least two important upshots. First, I argue that the existence of bias that is intrinsic to certain institutions (whether algorithmic or not) suggests that at least in some cases, the algorithms now substituting as pieces of institutional norms or rules are not “fixable” in the relevant sense, because the institutions they help make up are not fixable. Second, I argue that in other cases, changing the algorithms being used within our institutions (rather than getting rid of them entirely) is essential to changing the background structural conditions of our society. En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

The essay aims to offer some thoughts about the configuration of the subject as a category of analysis for the understanding of citizenship. For this purpose, two key dimensions are outlined: ideal and empirical. The arguments presented allow an understanding of citizenship as a symbolic construct fraught with tension, beyond the legal and administrative dimension; for example, through its links with migration, racism and identity. Finally, it presents what we have called the ideal-empirical subject, as a construct that contributes to (...) the understanding of social reality from the perspective of the subject as irreducible singularity. The central thesis of this essay is that citizenship, as a construct supported in the inclusion exclusion dichotomy, operates as a shaping element of the ideal-empirical subject in modern societies, and more specifically in globalized post-industrial societies. El ensayo tiene por objetivo exponer algunas reflexiones relativas a la configuración del sujeto como categoría de análisis para la comprensión de la ciudadanía. Para estos efectos se plantean dos dimensiones claves, la ideal y la empírica. Los argumentos que se presentan permiten captar la ciudadanía como un constructo simbólico cargado de tensiones, más allá de la dimensión jurídica y administrativa; por ejemplo, por medio de su articulación con las migraciones, el racismo y la identidad. Finalmente se expone lo que hemos denominado el sujeto ideal-empírico, como constructo que contribuye a la comprensión de la realidad social desde la perspectiva del sujeto, en tanto singularidad irreductible. La tesis central de este ensayo es que la ciudadanía en tanto constructo sustentado en la dicotomía inclusión exclusión opera como elemento modelador del sujeto ideal-empírico en el escenario de las sociedades modernas y más específicamente en las sociedades postindustriales globalizadas. The realization that there is a process of transnationalization of the Brazilian prison-based criminal group self-named First Command of the Capital can only be understood as an effect of the practices, forms of operation, activities, and configurations taken by criminal networks within the structural changes associated with globalization, particularly the dynamics of the illicit markets for cocaine and marijuana. Understanding PCC's process of transnationalization entails considering the specificities of a group that has its origins in prisons and the particularities of (...) the Brazilian criminal dynamic, in the center of which prisons occupy an increasingly important place. Even though PCC has participated and amplified its international presence, and has in fact entered these global networks to operate within them, they do so in a way that is still devoted to its performance in Brazil. However, there are elements that indicate that the group is evolving toward new configurations in this global criminal market, especially that of drug trafficking. (shrink)

El artículo relaciona el nuevo orden narrativo con la técnica del “storytelling” y cómo se manifiestan en el periodismo actual. Se estudian los casos de tres periodistas: David Simon, Stieg Larsson y Ryzard Kapuscinski y cómo su obra muestra la difusa línea de los hechos, la recreación, la invención, la fábula, la historia, la apariencia y la verdad. Se contrastan estos casos con las aportaciones del paradigma narrativo de Fisher. Nos preguntamos también cómo se crean narraciones en Internet a partir (...) de los periodistas estudiados. El ámbito de la verdad periodística se entremezcla con una apariencia de verdad mientras la ficción que aparenta realidad se convierte en acercamiento a ésta. La aproxi-mación a este fenómeno, que se inicia a finales del siglo XX y se consolida en la primera década del siglo XXI, se lleva a cabo desde las aportaciones de la Teoría de la Comunicación. The failure of many patients with chronic conditions to correctly follow medical advice that they hope or intend to follow is a major concern, especially as effective long‐term therapies for chronic conditions materialize. Some US healthcare providers have responded with strategies that involve implementing contracts with their patients, including provisions that may deny future treatments after continued nonadherence. This is among the first articles to explicitly discuss the ethics of patient contracts.

It is commonly understood that over-arching transcendental values (TVs) play a major role in directly influencing individual and group behaviours, including those relating to the environment. This paper challenges this approach, by arguing that there is good evidence to indicate that personal contexts – rather than TVs – inform many decisions that individuals need to make. As such, the paper argues that individuals use their TVs as a guide to forming contextual values, in a way that TVs only influence daily (...) behaviours indirectly. In order to review the potential utility of these arguments, we offer a secondary analysis of the International Social Survey Programme. The results indicate that contexts can influence behaviours independently of the set of (transcendental) values that people may hold. (shrink)

The Mapuche people are a native group from the extreme south of Latin America. Their culture is based on the interconnectedness between the cohabitants of the environment, including human and non-human categories of life. The closest concept to consciousness for them would be Mapuche rakizuamor Mapuche thinking, which is defined as a particular kind of reflexivity or state of awareness of the interdependence of people with natural and spiritual entities. This understanding of the human condition represents a relational ontology, which (...) cannot be translated to the predominating individualistic approach. Although the mind–body distinction is not a central point within Mapuche culture, these dimensions can be explored through crucial processes of the life cycle such as socialization, illness, and death. Contributions from cultural psychology and Indigenous psychology are taken into account regarding the challenge to address the interplay between culture and the human psyche more appropriately. O objetivo do artigo é explorar as conexões entre o problema da morte, o conceito de ideia e a tese da indestrutibilidade do nosso ser com a morte, em Schopenhauer. Como ponto de partida, é apresentada a crítica de Schopenhauer à compreensão empírica da morte como passagem ao não-ser. Passa-se, então às considerações do filósofo sobre a indestrutibilidade do nosso ser com a morte, por meio do destaque às suas considerações sobre o caráter de coisa, vinculado à sua intepretação das (...) ideias como formas eternas. Após discorrer pontualmente a respeito do sentido desta noção na filosofia platônica, são apresentados os principais elementos que configuram a apropriação schopenhaueriana da teoria platônica das ideias tendo em vista exclusivamente o problema elegido, qual seja, a morte e a indestrutibilidade do nosso ser. O objetivo geral deste artigo é contribuir para as reflexões sobre as relações entre ética e linguagem a partir da obra de Wittgenstein, buscando compreender em que medida há uma irredutível dimensão ética envolvida nos limites da significação. Para tanto, retomamos as considerações sobre ética presentes no Tractatus, nos Notebooks 1914-1916 e na Conferência sobre Ética. A maior parte dos desenvolvimentos deste texto versa sobre a abordagem do ponto de contato entre ética, lógica e ontologia, levando em contaa influência de (...) Schopenhauer na primeira filosofia de Wittgenstein. Nosso horizonte, entretanto, consiste em contribuir para questão dos desacordos profundos, no âmbito da sua filosofia tardia, no que se refere aos princípios éticos radicalmente distintos. Sobre isso, estamos conscientes de que aqui apenas tocamos a matéria, indicando caminhos possíveis, e que o presente trabalho constitui um passo a ser retomado em análises futuras.AbstractThe general objective of this paper is to contribute to reflections on the relations between ethics and language based on Wittgenstein’s work, seeking to understand the extent to which there is an irreducible ethical dimension involved in the limits of meaning. Therefore, we return to the considerations on ethics present in the Tractatus; in Notebooks 1914-1916 and in the A Lecture on Ethics. Most of the developmentsin this paper deal with approaching the point of contact between ethics, logic and ontology, taking into account Schopenhauer’s influence on Wittgenstein’s first philosophy. Our horizon, however, is to contribute to the issue of deep disagreements, within the scope of his later philosophy, with regard to radically different ethical principles. About this, we are aware that we are only touching on the matter here, indicating possible paths, and that the present work is a step to be taken up again in future analyses. (shrink)

ABSTRACT This article proposes a reading of the novel O pai da menina morta [Dead Girl’s Father], by Tiago Ferro, linked to the theme of Christian resurrection materialized in the Gospel according to John. The biblical episodes about the resurrection of Lazarus and Jesus Christ are placed in dialogue with the narrative of the Brazilian author, as well as the symbolisms regarding the pelican and the celebration of Christian Easter, figures belonging to the structure of the work under examination. The (...) analyses put in discussion promote the understanding that Tiago Ferro, when indicating the religious discourse, refracts it to the constitution of his narrative voice, relocating it to the secular, profane level, typical of the human condition. The theoretical foundation working as a support for the reading of this work stands out in the contributions of the Circle of Mikhail Bakhtin, Frederico Lourenço, Northrop Frye, among others. Considerando que a mulher que se encontra numa relação amorosa violenta, muitas vezes, persiste na manutenção dessa conjugalidade, este estudo objetivou investigar a experiência emocional de mulheres que vivenciam ou já vivenciaram uma relação conjugal violenta. Foram realizadas entrevistas individuais com seis mulheres beneficiárias de uma ONG dedicada à violência intrafamiliar. Cada entrevista foi mediada pela apresentação de uma narrativa interativa, a partir da qual a participante era convidada a inventar o desfecho. Após cada entrevista, a entrevistadora redigiu uma narrativa (...) transferencial sobre o encontro. O conjunto das narrativas transferenciais foi analisado psicanaliticamente à luz da Teoria dos Campos. Foi identificado o campo “Infeliz(es) para sempre”, em que as participantes manifestaram sofrimento radical frente à possibilidade de ficarem sozinhas, “preferindo” compartilhar a infelicidade com o cônjuge agressor a lidarem com o desamparo. Considera-se que tais achados podem auxiliar na intervenção dos profissionais que atuam junto a esse grupo social específico. (shrink)

No que toca a filosofia do direito muitas são as dúvidas que recaem sobre as distintas noções de direito consideradas não só nas reflexões teóricas sobre a jurisprudência, mas também aquelas que surgem pela _práxis_ do sistema jurídico. Qualquer noção subjetiva de direito, além de (...) ser desprovida do sentido lato do termo, se atribuída aos filósofos antigos e medievais, não passa de uma reinterpretação errônea. Entretanto, este artigo tem por objetivo mostrar que a argumentação de Villey contém algumas lacunas quanto a sua interpretação da noção de direito em textos como os de Gaio e de Tomás de Aquino. Posição essa sustentada através de autores como Brian Tierney e Alfredo Storck, os quais apresentam uma leitura pluralista acerca das noções de direito da antiguidade e do medievo mostrando que, ainda que não houvesse a presença do termo “direito subjetivo” no vocábulo da jurisprudência da época, por vezes, o direito era empregado nesse período para significar um poder, uma liberdade ou uma vantagem do indivíduo. Existe uma reconhecida proximidade entre os materialistas franceses do século XVIII que teria se mostrado tanto em investigações sobre a natureza quanto à moral e organização pública. Porém, as divergências entre eles podem desencadear um entendimento muito diferente sobre como se considera uma sociedade.
